Intrastat - novità dal 2010
From January 1, 2010 shall be operational as a legislative decree transposing the directives of 8/CE 117/CE of 16.12.2008 and 02.12.2008; are changed:
1) territoriality of the performance of services (dir. 8/2008/CE)
A_viene extended the obligation to complete and submit the Intrastat to supplies of services rendered within the EU. Until 2009 I remember the Intrastat forms were required only for sales / purchases of goods and services.
B_il place of taxation for VAT purposes in respect of services rendered by individuals against other individuals VAT tax resident in EU countries is the establishment of the customer (customer). In other words, if we give services to companies (soggetti IVA) residenti in UE, in fattura addebitiamo l'aliquota IVA esistente nel loro Paese. Se il committente (cliente) non è titolare di partita IVA (ente o privato) l'IVA da addebitare in fattura è quella vigente in Iitalia.
2) modalità di presentazione dei modelli Intrastat (telematico) (dir. 117/2008/CE)
obbligo di presentazione in maniera telematica dei modelli Intrastat (non più cartacei, né con "dischetto"). Per abilitarsi alla trasmissione telematica vedere il sito www.agenziadogane.gov.it e seguire le istruzioni per le autenticazioni (chiedere PIN, installare software, ecc.)
3) scadenze dei modelli Intrastat
il principio generale è che il modello Intrastat telematico must be sent on a monthly basis (within 19 days of the month following the month of competence).
Notwithstanding, for subjects in the four previous quarters had less than 50.000euro Intra volume can be submitted quarterly. The submission deadline is the 19th day of the month following the quarter for the period (eg 19 April for the first quarter 2010).
NB: There is no longer able to send Intrastat year!
